I hereby acknowledge that I am aware of the allegedly addictive nature of using products containing nicotine and the potentially harmful effects associated with the use of any tobacco product. I further represent that I was a voluntary tobacco user before applying to become a "tobacco product sampler" and I recognize the inherent risks associated with this activity and release BBK Tobacco & Foods, LLP dba HBI International ("HBI") its officers, directors, trustees, HBI's successors and assigns, employees and all other qualified personnel working under the supervision of HBI and HBI’s officers, directors, trustees and employees in the conduct of HBI's normal business activities from and against any and all liabilities, damages, claims, losses, settlements, judgments and expenses (including reasonable attorneys' fees and costs), incurred by or asserted against HBI for such liabilities, damages, claims, losses, settlements, judgments and expenses arising out of any liability that may arise from my use of tobacco and/or tobacco related products provided by HBI as samples or the negligent acts or omissions of HBI except for those claims arising from negligent, reckless or intentionally harmful actions of the HBI.
Furthermore, I represent that I am 21 years of age or/older and that I am of the legal age to purchase and/or use tobacco products. I voluntarily requested the opportunity to become a "tobacco product sampler" of my own free will and volition and I was not promised any compensation for sampling the products or coerced into becoming a "tobacco product sampler."
I REPRESENT THAT I HAVE MADE FULL DISCLOSURE AND HAVE READ, UNDERSTAND AND ACCEPT THE TERMS AND CONDITIONS STATED IN THIS AGREEMENT AND ACKNOWLEDGE THAT THIS AGREEMENT SHALL BE EFFECTIVE AND BINDING UPON THE PARTIES.
